ASTM does not guarantee access, and will not be liable for damages or refunds if the Product becomes unavailable temporarily, or if access becomes slow or incomplete due to system back-up procedures, Internet traffic volume, upgrades, overload of requests to servers, general network failures or delays, or any other cause that may from time to time make the Product unavailable for the Licensee or Licensee’s Authorized Users.

Alterations/Additions

All additions and new functionality will be incorporated at no additional charge.

Annual increases will be capped at a maximum of 4.8%

Price exclude VAT.

Payment Terms

Pricing is effective 1 January 2013.

Institutions will be invoiced for the Agreement year in which their Licence starts.

In subsequent years, Institutions will be invoiced three months in advance of their licence anniversary date.

All Purchase Orders must be made out to Eduserv and Eduserv's invoices must be paid within 30 calendar days of the date of the invoice.

Agreement Period

Start date: 1 January 2013 End date: 31 December 2015

Institution Commitment Period

This Commitment Period is of 3 years. Institutions may join the agreement at any time during the agreement period.

This agreement is under  ASTM Subscription License Agreement (PDF, 121 Kb)  .

All parties are working towards putting the agreement under the standard Chest agreement as soon as possible.

Who can use the resource?

The resources are licensed for all Authorised Users, defined as Students, Staff and Walk-in Users.

Termination Clauses

Archive Rights
Under 3 year licence - a licensed site retains right to access everything published during that thirty six month period. If a site Opts out they lose all retention rights.

Personal Licences

Personal Licences are not available under this Agreement.

 

 

Trials

Each Institution is offered a one-time option of obtaining pre-subscription free trial access to the Products for a period of thirty days at any time during the term of the agreement subject to availability. A trial includes the rights to twenty-five downloads; Please apply to Eduserv.
