Preferential Fees for renewing sites who renew BEFORE 31 May 2012

Where a Licensed Institution holds a three year Licence under the previous agreement and paid for that licence 'upfront' with a single one-off payment, that licensed Institution may, at the expiry of that licence, renew it for a further three year period with a single "upfront" one-off payment at the preferential fee of $31,980.

The Renewal Date of the licensed institution's licence under the previous agreement falls between 1 June 2011 and 31 May 2012. 'Renewal Date' is here defined as the date immediately succeeding the date when the Licence issued under the previous Aareement expires; and the Licensed Institution applying for this preferential fee completes and returns an Order to Eduserv before the expiry of the Licence issued under the previous agreement.



Payment Terms

Payment is due on receipt of licence. There shall be no pro-rating of the fee. Each licence shall be valid for a 1 or 3 year period from date of issue.

You may choose to be invoiced in US dollars or in UK Sterling - please state your preference on the licence form.

All Purchase Orders must be made out to Eduserv and Eduserv's invoices must be paid within 30 calendar days of the date of the invoice. 
 

Agreement Period

Start date: 01 June 2010 End date: 31 May 2013


Institution Commitment Period

This Agreement commences 1 June 2010 and terminates 31 May 2013. Institutions may participate at any time during the period.

  • The Institution commits to pay a three year upfront fee on signing up to this agreement which will licence that institution for use of the product for three years or
  • An institution can commit to a one year term or
  • An institution can commit to three annual instalments.
Rights vary depending on the commitment period.

Licence Type

Site licence
On initially accessing the ASTM Digital Library & Standards Package (the Package) through the ASTM International website, a user at a Licensed Institution will be guided through a standard ASTM International "click-through" licence. The user will have to accept the Terms and Conditions of this licence to gain access to the Package. The Terms and Conditions which apply to a Licensed Institution purchasing access to the Package through the Eduserv / Content Online Agreement are the Terms and Conditions of the Eduserv / Content Online Agreement and the Terms and Conditions of the ASTM International "click-through" licence. Licensed Institutions should satisfy themselves that they are content to abide by both sets of Terms and Conditions. In the event of a conflict between the Terms and Conditions of the Eduserv / Content Online Agreement and the Terms and Conditions of the ASTM International "click-through" licence then the Terms and Conditions of the Eduserv / Content Online Agreement shall take precedence.

Who can use the resource?

Authorised Users

'Authorised User' means a type of user who is a currently registered student of the Licensee, a faculty member or an employee of the Licensee, in each case authorised by the Licensee to access the Licensee's library and information services whether from a computer or terminal on the Licensee's Secure Network or offsite via a Secure Access Management System or, in the case of Licensed Materials, access to the Licensee's onsite library facilities.

The following table indicates the Other Permitted Users  that are permitted to have access to the Products via a Licensee's library and information services whether from a computer terminal on the Licensee's Secure Network or offsite via a Secure Access Management System or via the Licensee's onsite library facilities:

What can authorised users do?

The resource can be used for teaching and learning, research, personal educational development, administration and management of the business of the Licensee's organisation or development work associated with any of the above.
They must;

  • Not permit others to access, print or download the resource or make or copy Licensed Materials
  • Not use the product for commercial purposes or for any purpose other than educational use
  • Avoid downloading that might be considered "systematic".

Termination Clauses

1 year only licence - a licensed site retains right to everything published during that twelve month period.

3 year licence - a licensed site retains right to access the archive and everything published during that thirty six month period.

Material, for which these rights are held, may continue to be accessed and downloaded under the Agreement after its expiry and can continue to be used under the same licence conditions as pertain while the Agreement exists.

Personal Licences

Personal Licences are not available under this Agreement.

Trials

Each Institution is offered a one-time option of obtaining pre-subscription free trial access to the Products for a period of thirty days at any time during the Term subject only to the availability of the Products. Such a trial shall include the right to twenty-five downloads; Please apply to Eduserv.
