Institutions may participate in the Agreement at any time during its life, but shall be bound by its Terms and Conditions, in perpetuity. Payment is a one-time fee for the product.

This Agreement is available to Institutions of Higher and Further Education and Research Councils in the United Kingdom, and to Universities and Colleges of Further Education in the Republic of Ireland.

4. Product Description

MindGenius is a mind mapping application that allows students to capture and visualise ideas and information. The unique Map Explorer in MindGenius allows you to navigate through large amounts of information with ease, go onto analyse and categorise your map, and start to see visual links between ideas, all helping you to develop understanding and clarity on the way ahead. MindGenius helps with collaborative learning, essays, projects, class presentations, study, mind mapping, and lesson planning.

5. Licence Type

This Site licence is subject to Eduserv General Licence Terms and Conditions for Software, as amended by the Special Licence Conditions and MindGenius Licence Terms and Conditions.

Machines on which the software is installed must be under the jurisdiction of the institution. You may not install the software on student or employee owned machines.

Copying of the Software is allowed at any Institution for use by any member of staff or student in accordance with the General Licence Conditions for Software.

6. Personal Licences

Personal licences are not available under this Agreement. Individuals interested in purchasing personal licences should contact MindGenius directly.

7. Post Termination of Agreement Period

At the end of the Period of Agreement Licensed Sites may continue to use MindGenius 3 in perpetuity in accordance with the terms of the Licence.

8. System Releases, New Versions and New Functionality

This Chest Agreement is open to sites wishing to upgrade from v2 (2005) -- or earlier -- to the latest version 3 of the software. The Chest Agreement is also open to new purchasers of MindGenius 3 (Education). Both upgrade and new purchasers of the software must purchase the software outright under this Chest Agreement. Licensed sites will have free access to patches, bug-fixes and updates for as long as they are available via the MindGenius website. Licensed institutions will not be entitled to free version upgrades.

9. Location and Use Permissions

The product(s) may be used by any employee, student or other persons authorised by the Licensee for the purposes of the normal business of the Licensee’s organisation. These permissions are described in the General Licence Terms and Conditions for Software, as amended by the Special Licence Conditions and MindGenius Licence Terms and Conditions.

10. Background Detail/Community Evaluation

The issue of accessibility in IT has been well documented since the details of the Special Educational Needs & Disability Act 2001 were made known. Eduserv wished to support Higher and Further Education by enabling access to and usage of digital information and resources. To further that aim, in 2003 Eduserv funded the purchase of national site licences for a number of assistive technology products, and made the products available at no charge to Institutions, under the terms of the Eduserv Foundation Programme, 2003, Assistive Technology Strand.

In association with TechDIS, Eduserv identified MindGenius as a product that may assist all staff and students with the organisation of their work, but in particular can assist staff and students with Dyslexia and other learning difficulties. Eduserv acknowledge the help provided by the JISC TechDis Service www.techdis.ac.uk/

The national site licences funded by Eduserv included the option for those sites that took up a licence to convert it to a perpetual licence for the then current version of the software, MindGenius v1.51, before 31 July 2005.

In 2005 another Chest Agreement was negotiated in order to provide sites with the option of purchasing a perpetual site licence for the most recent version of the software, MindGenius v2 (Education). This is a rolling agreement with no end date, although pricing is agreed on an annual basis.

The new release of MindGenius 3 (Education) has prompted the updating of this Chest Agreement to include this latest version. This Chest Agreement is open to sites wishing to upgrade from v2 (2005) to the latest version 3 of the software. It is also open to new purchasers of MindGenius 3 (Education).

12. Product Documentation

Full product documentation is built into the help menu of the software. There is no paper-based manual.

One-day classroom training courses may also be arranged with MindGenius. The MindGenius Practitioner Course can be delivered Off Site where companies can book a MindGenius training room exclusively for a maximum of eight of their own staff. The cost is £1500 + VAT per day. Alternatively a MindGenius expert can visit your own site and take a group through the Practitioner Course. The cost is £1500 + VAT + reasonable expenses (Travel, accommodation, etc).

15. Initial Consultancy/Support

Software Implementation Support Services will be provided by MindGenius to a Licensed Site from the date of the delivery of a licence purchased under this Agreement by that Licensed Site until a full twelve months after the activation of the same licence. However, without prior arrangement between MindGenius and Licensed Site there will be no further provision of Software Implementation Support Services at the end of that twelve month period.

Support will be provided by MindGenius via a single Technical Contact or his/her deputy at each institution.

Banding for UK sites is based on JISC Banding. Eduserv and MindGenius have agreed on banding for Ireland. The pricing is the same whether a site is "upgrading" or purchasing MindGenius for the very first time.

VAT will be added to the amount above at the standard rate.

The above pricing is a one-off single payment for perpetual access to MindGenius 3.5. This is a site licence but the software may not be installed on staff or students personal machines.

21. Payment Terms

On receipt of two completed Licences/Schedule 4 (Schedule of Particulars) plus an Institution Purchase Order made payable to Eduserv, sites will be invoiced for the Agreement year in which the Licence is signed. Prices exclude VAT.

All purchase orders must be made out to Eduserv and payments must be paid within 30 calendar days of the date of invoice.
