AVS Agreement Overview

1. Agreement Details

(i) Product full name

The Agreement is primarily for the provision of AVS/Express Visualization Edition. Two additional options are also available:

(iv) Agreement Period

This is a 5 year Agreement which terminates on 30th June 2012. Institutions may participate at any time during the period; however they will be bound until the end of the Institution Commitment Period.

(v) Institution Commitment Period

Sites have the option to commit to one of the two following end dates:

* This option is available in the first year of the agreement (to 30th June 2008) only.

Sites that commit to the earlier end date may extend their licence to the Agreement end date, on completion of an Order Form.

The Agreement to which this refers is a formal agreement between Eduserv and Advanced Visual Systems Inc.

2. Eligible Sites

This Agreement is available to Chest Sites, FE Sites, some, but not all, Associated Sites and Chest (Ireland).

3. Background Detail / Community Evaluation

Eduserv has had an agreement with Advanced Visual Systems since July 1992, for the provision of AVS, the forerunner of the products covered by the new Agreement. The original agreement was amended in May 1994 to offer a per-platform licence, and was further amended in June 1996 to add the optional AVS/Express Developer Edition to the Agreement. Support of AVS5 on Linux was added in 1999. The AVS/Express Multipipe Edition was added to the Agreement in October 2000. The Agreement was renewed in 2002 for five years replacing the "per-platform" licence with a "75-User" all platforms licence and the option of the Parallel Edition for both AVS/Express Developer and AVS/Express Multipipe.

4. Products Covered

The Agreement is primarily for the provision of AVS/Express Visualization Edition software including HTML documentation. The charges also include support, new versions, and system releases. New platforms will be available within the charges if and when commercially available from AVS.

The AVS/Express Visualization Edition supersedes the forerunner AVS5 software product. This agreement references the AVS/Express software throughout and all Chest sites should only be licensing AVS/Express. For sites that had previously utilized the AVS5 software, there are certain circumstances where AVS will allow continued use of the AVS5 software. Media and carriage charge will be required for this product (currently £200).

Additionally, sites may license AVS/Express Developer Edition for which an additional licence fee applies. Licensing of AVS/Express Developer Edition or AVS/Express Developer and a Parallel Edition is conditional upon being licensed for AVS/Express Visualization Edition.

Alternatively, sites may license AVS/Express Multipipe Edition or AVS/Express Multipipe and Parallel Edition; there is no pre-requisite to be licensed for AVS/Express Visualization Edition.

AVS/Express Visualization Edition

The AVS/Express Visualization Edition offers scientists, researchers, and other technical professionals the most comprehensive suite of data visualization and analysis capabilities available today. It provides end users with state-of-the-art technology for advanced graphics, imaging, data visualization, and presentation.

AVS/Express Developer Edition

AVS/Express Developer Edition is a multi-platform, component-based software environment building applications with interactive visualization and graphics features. AVS/Express employs an innovative object-oriented visual programming interface to create, modify, and connect application components. Generated applications can be distributed as stand-alone executable code requiring an AVS/Express Runtime licence.

AVS/Express Multipipe Edition
AVS /Express Multipipe Edition brings the power of AVS visualization to collaborative virtual reality environments. The new AVS/Express Multipipe Edition offers scientists, researchers, and other technical professionals the most comprehensive suite of data visualization and analysis capabilities in a Multipipe or multi-channel display environment. With AVS/Express Multi-Pipe Edition, users can quickly change a display environment so an application being displayed on a desktop workstation can be deployed in an immersive SGItm Reality Centertm or CAVEtm environment.

AVS/Express Parallel Edition
This is supplied as an option to both AVS/Express Developer Edition and AVS/Express Multiple Edition.  The AVS/Express Parallel Edition provides a framework for parallel computation on multi-processor and networked computers.  The computation is distributed across shared memory or clustered processor architectures using MPICH for Windows or Linux and via MPI on SGI systems. Parallel Edition modules can co-exist with AVS/Express network modules, allowing existing applications to progressively utilise the results of the evolving Parallel Edition development program.

8. Institution Evaluation Copy / Exhibition Licence

Evaluation copies are available by contacting the AVS office.

9. Licence Type

Sites may chose from a full site licence or a 75 User licence with normal General Licence Terms and Conditions.

* A site can choose a combination of Floating and Node-Locked licenses up to a maximum of 75. For example a site could choose to have 75 Floating licenses and 0 (zero) Node-Locked licenses or 50 Floating licenses and 25 Node-locked licenses. The site must decide at the time the agreement is taken out the ratio between Floating and Node-locked licenses. The Node-locked license is intended for use on a computer that needs to be used when not connected to a network. There is no ability for the Node-Locked license to be temporarily reallocated to another user when the computer is connected to a network. A maximum of one license license change per year will be permitted for each Node-locked license issued.


Copying of the Software is allowed at any licensed Institution for use in accordance with Clause 3 of the General Licence terms and Conditions.

AVS/Express Developer Edition. Sites have a choice of three (3) Licence Category bands:

*This licence may be upgraded to a higher licence band at a cost of 1.2 times the difference.

Sites may also purchase extra developer and runtime licences. Purchasing of additional licence seats at the appropriate unit price will be accepted as packages of value not less than £300.00. The additional annual charges depend on the Licence Category selected.

AVS/Express Developer and Parallel Edition. Sites have the same choice of Category bands as those available under AVS/Express Developer Edition.

AVS/Express Multipipe Edition. Sites are entitled to have up to 55 licence seats for this product. There is no pre-requisite to be licensed for AVS/Express Visualization Edition.

10. Personal Licences

Personal copies are available for staff and students direct from AVS. The current prices for AVS/Express Visualization Edition are:

11. Post Termination of Agreement Period

At the end of the Agreement Period, or Institution Commitment Period, whichever is earlier, if no new Agreement is negotiated between Eduserv and AVS, sites will be required to remove from their machines all copies of products licensed. This does not apply to any Personal Licences purchased. 

12. Product Documentation

All documentation is provided online in HTML format with the current version of the software.

NB: Distribution of media and documentation for AVS5 will be charged separately by AVS. Current charge for this is £200. This charge will be applicable for each release of the software that a site requests as an upgrade.

13. Right to Copy Documentation

Copying of Licensed Materials is permitted for use at the Licensed Site within the terms of the Licence.

14. Training and Training Materials

Training courses may be provided in accordance with prices in force from time to time. Academic institutions are offered a 50% discount on on-site training course prices, which are subject to negotiation.

AVS/Express Visualization Edition training can also be downloaded via the International AVS Centre (IAC) web site at Manchester University: http://www.iavsc.org, and courses are also held at Manchester based on this material.

Training materials provided at AVS training courses may be duplicated, for internal use within the Institution only, and must not be used for delivering external training courses.

15. System Releases, New Versions and New Functionality

Updates and new versions can be downloaded from the download site at: http://download.avs.com/Toolmaster/.  Access to each version is password protected and Technical Contacts and/or Deputy Technical Contacts named on the Schedule 4 licence should email supporteurope@avs.com to obtain the download passwords.

16. Initial Consultancy/Support

Support will be provided by AVS via a single contact or his/her deputy at each Site. Sites may nominate additional pair(s) of Technical Contacts, by completing an Addendum A to Schedule 4, the charge for which is £250 per Contact/Deputy.

Additional Technical Contacts:
A charge of £250 p.a. will be levied for each pair of additional Technical Contacts nominated, on completion of Addendum A to Schedule 4 (7K RTF file to download).

To all the above charges will be added VAT at the prevailing rate.

18. Payment Terms

On receipt of a completed Licence, Sites will be invoiced for the Agreement year in which the Licence is signed.

For each subsequent year, Sites will be invoiced annually three months in advance of the anniversary date of the Agreement (invoice date: 1st April) for the remaining period of their Commitment Period.

There is no pro-rata charging for Sites that become licensed part-way through a year. However, a 50 percent prorata charge will be applied to the second year fee if the initial AVS/Express Multipipe Edition Licence is taken on or after 1st January in any licence year.

All payments must be made to "Eduserv" within 30 calendar days of the date of invoice.

19. Method of Delivery of Product

The master copies of media and Licensed Materials will be supplied by AVS when the Licence is signed by the Site and returned to Eduserv. See 21. How to Order below.

Distribution of media and documentation for an operating system that is deemed a "legacy" OS will be charged separately by AVS. Current charge for this is £100 plus VAT.
