Research for Libraries Agreement

  

 

1. Agreement Details

This Overview represents the detail of the formal Agreement which exists between Eduserv and Research for Libraries. The following sections are written to enable Institutions to make a decision as to whether or not the product is appropriate for their needs.

(v) Agreement Period

Sites can sign-up to a 3-year licence at any point during the Agreement Period (1 August 2007 through 31 July 2010).  Institutions will be bound for a full 3 year term from the date of joining (thus, the Licence Period will extend beyond the Agreement Period) and pricing has been agreed until 2012. . 2. Eligible Sites

This Agreement is available to Higher Education and Further Education in the UK, Third Level Colleges in the Republic of Ireland and to Chest Associated, IATUL and SURFdienstein Sites. Research councils will be reviewed on a case by case basis.

Online service providing access to all Business Insights strategic management reports. The reports are based upon market research and provide detailed analyses of major markets, examining the market dynamics, assessing the relative strengths and weaknesses of the key players and providing forecasts for market size and composition.

This service also has optional interactive functionality which enables greater levels of analysis and interrogation of reports. Reports can be translated into staff and students' native languages.

Online service that uses desk research and primary and secondary data sources to create a business information portfolio. The resource contains:

Verdict Research

Verdict Research is a leading authority on retailing in the UK and Europe and publishes independent analysis of the retail industry. Verdict Research Reports provide students with comprehensive pictures of the retail sector and forecasts to help them create accurate and up-to-date coursework and to undertake personal research.

All profiles and reports are supported by news, comment and analysis from specialist analysts.

5. Licence Type

Site licence with normal Chest terms and conditions of use. Downloading of the Data is allowed at any Institution for use by any member of staff or student in accordance with the standard "Code of Conduct" for the Use of Software or Data.

6. Post Termination of Agreement Period

Material downloaded under the agreement before its expiry may continue to be used under the same licence conditions as pertain while the agreement exists. Once the agreement has terminated then no further access to the service will be possible unless the Agreement is renewed or extended. If the Agreement is renewed or extended then the new conditions will apply. If the Agreement is not renewed then renewal is a matter between Institutions and Research for Libraries.

7. Alterations/Additions to Databases and New Functionality

Any additional features or functionality that becomes included as a standard part of the products covered by this agreement will be included within this agreement at no extra cost.

8. Location and Use Permissions

"Authorised Users" are those individuals who are authorised by the Licensee to access the Licensee's information services available through the Licensee's Secure Network and who are (i) affiliated with the Licensee as a current student, faculty, employee, or in some other capacity whereby they are permitted to access such services in the Licensee's ordinary course of business, whether from a computer or terminal on the Licensee's Secure Network, or offsite via a modem link to a valid IP address on the Licensee's Secure Network; (ii) additionally, in the case of walk-in users, they must be physically present on the Licensee's premises.

For clarity, and in response to frequently asked questions, the following additional definitions are given.

It remains a requirement of the Licensee (Institution) that it is satisfied that the user is an employee, student, or other person authorised by the Licensee for the purposes of the normal business of the Licensee's organisation.

NOTE: the granting of an Athens Username and Password is not a right to use in itself.

DISTANCE LEARNING: The following sections are applicable to UK Institutions. Non-UK Institutions should consult with Chest.

DISTANCE LEARNING:
Distance learning is any learning that takes place with the instructor and/or necessary materials geographically remote from the student. For example distance learning may occur by surface mail, video, interactive or cable TV, satellite broadcast, or any number of Internet technologies such as message boards, chat rooms, and desktop video or computer conferencing. The student may be either normally UK domiciled or permanently domiciled overseas.

Students studying via Distance Learning can be categorised as:

  1. UK domiciled, UK Based, i.e. all Students resident and studying within the UK.

  2. Non-UK domiciled, UK based, i.e. a Student with an overseas home address but studying within the UK.

  3. UK domiciled, non-UK based, i.e. British nationals on business or studying abroad.

  4. Non UK-domiciled, non-UK based. i.e. Overseas home address studying abroad.

The licence for Business Insights and Marketline permits such use.

REMOTE ACCESS within UK and EIRE:
Access to data service and content geographically remote from the licensed institution but within the boundaries of the UK and Eire.

The licence for Business Insights and Marketline permits such use.

REMOTE ACCESS Overseas:
Access to data service and content via a licensed institution from outside the UK and Eire.

The licence for Business Insights and Marketline permits such use.

STUDENT PLACEMENT IN INDUSTRY:
A registered student of an institution who combines academic study with periods of practical work experience e.g. Sandwich Students.

Any use for the benefit of the student's employer is specifically excluded.

PEOPLE FROM INDUSTRY ON COURSES RUN FOR THEIR EMPLOYER:
Industrial placement.

Such use is specifically excluded from licence for Business Insights and Marketline.

RETIRED MEMBERS OF STAFF:
Former employees of a licensed institution.

Use rights terminate upon cessation of employment, except in the instance where the employee becomes a student or is authorised by the licensee as a walk-in user.

HONORARY MEMBERS OF STAFF:
Persons of eminence in their field, and those who perform extraordinary meritorious service to an Institution.

Such use would be permitted except where the user was doing so in pursuit of their non-academic activity.

ALUMNI:
Graduates of an Institution.

Use should terminate upon graduation and not be permitted again unless the graduate again qualifies under the terms for employees and students.

WALK-IN USERS:
Public access and Library terminals.

Use by walk-in visitors or general public users is not allowed unless the user is authorised by the institution. It is generally acknowledged that licensed institutions may be unable to segregate public or library computers from the rest of the network and that occasional walk-in, public use may occur.

It remains a requirement of the Licensee (Institution) that it is satisfied that the user is an employee, student, or other persons authorised by the Licensee for the purposes of the normal business of the Licensee's organisation.

9. Background Detail/Community Evaluation

This is the second three year agreement between the supplier and Eduserv Chest.  These products were well established in the HE market and Research for Libraries was interested in promoting them in the FE and other sectors. Research for Libraries first contacted JISC in June 2003 and they carried out a consultation exercise in HE and FE. Both sectors were interested in an agreement for these products. After discussions between JISC and Eduserv Chest it was felt appropriate that Chest should conclude the negotiations and open the Agreement up to additional sectors, particularly IATUL, SURFdienstein and Public Libraries.

Product Documentation includes any user manuals, guides, tutorials are provided online.

12. Right to Copy Documentation

Copying of Licensed Materials is permitted

13. Training and Training Materials

The Agreement includes the provision of training and awareness sessions by arrangement with the supplier.

PC and browser software should be checked before startup.

In addition, you must enable your browser to accept cookies and Javascript.

18. Updates

New reports are added to Business Insights on a monthly basis.

MarketLine is updated on a daily basis.

Access Asia and Verdict Reserach are updated as necesary.

19. Access to Service and Downloading

When the Licence is signed by the Site and returned to Chest access to the products will be authorised by Chest and the Supplier and Athens will be advised.

Licensed Sites and their authorised End Users may print or download full or partial results of any searches of, and data in the licensed products subject to the terms and conditions in the Licence.

20. Athens Access Management System

Access will be authenticated by use of Athens Management System or by IP address.

21. Registration Procedures

For Athens access each licensed institution is required to have an Athens Domain Administrator before registering for access to the data. Please contact the library that issued your Athens account.

22. Pricing

At the request of the supplier we have had to restrict access to the pricing details. Please contact Eduserv Help to request a pricing quote and Licence Form.

23. Payment Terms

On receipt of a completed Licence, Sites will be invoiced for the Agreement year in which the Licence is signed.

For each subsequent year, Sites will be invoiced three months in advance of the anniversary date of the Agreement (i.e. Invoice date: 1 May 2008, 2009 for an Agreement starting on 1st August 2007) 

All payments must be made to "Eduserv" within 30 calendar days of the date of invoice.

Note: You are advised that because of the requirement for Chest to collect monies due before the anniversary date two charges may fall initially into one academic accounting year.

24. How to Order

One original copy of the Schedule 4 Licence (see 22. Pricing) is required and should be returned to Eduserv.
