1. Agreement Details

This Overview represents the detail of the formal Agreement which exists between Eduserv and Nielsen Book Services Ltd. The following sections are written to enable Institutions to make a decision as to whether or not the product is appropriate for their needs.

2. Eligible Institutions

This Agreement is available to Higher and Further Education in the UK, Associated Sites, Third Level Colleges in Ireland (Chest Ireland), SURFdiensten in the Netherlands and NHS Sites.

4. Product Description

Nielsen BookData is offering the following services through this Agreement:

The services offer comprehensive bibliographic data for English-language books and other published media. Databases include in-print, forthcoming and out of print titles - basic records, enriched data, including Tables of Contents, jackets/cover images, price, availability, extensive classifications and descriptive content. These are subscription services available via the Internet.

5. Licence Type

Site licence with normal Chest Terms and Conditions of use. Downloading of the Data is allowed at any Institution for use by any member of staff or student in accordance with the standard Code of Conduct for the Use of Software or Data.

6. Personal Licenses

Not applicable.

7. Post Termination of Agreement Period

Material downloaded under the agreement before its expiry may continue to be used under the same licence conditions as pertain while the agreement exists. Once the agreement has terminated then no further access to the service will be possible unless the Agreement is renewed or extended. If the Agreement is renewed or extended then the new conditions will apply.

8. Alterations/Additions to Databases and New Functionality

Alterations to the databases will not affect the product set and Nielsen BookData has committed to ensure continuity of data. New content such as data from additional countries may be made available to Nielsen BookData's Search & Discovery Tools, but will be subject to further negotiation between Chest and Nielsen BookData.

10. Background Detail / Community Evaluation

This Agreement has been negotiated on behalf of the Education Community. There has been no formal evaluation of this product on behalf of the Community, but Institutions are able to make use of a free trial in order to evaluate the product. The benefits of the BookData ONline service for librarians, teaching staff, students and researchers is descibed in this Nielsen Document.

11. Institution Evaluation

Nielsen BookData's Search & Discovery Tools may be evaluated free of charge for a period of not more than two months by calling Nielsen BookData on 01483 712 200 or by email to libraries.book@nielsen.com. Please copy Chest in on any requests for a trial.

12. Product Documentation

Copies of a Product Users Guide are available from Nielsen BookData on request from Licensed Sites.

13. Right to copy documentation

Copying of Licensed Materials is permitted for reasonable reference use.

14. Training and Training Materials

The Agreement includes the provision of training (upon request from a Licensed Site and at a mutually agreed date and time), and training material which consist of a Product Users Guide, available from Nielsen BookData on request from Licensed Sites.

19. Method of Access

20. Terminal/Network Requirements

Internet capable PC with at least a 32mb modem.

21. Updates

These services are databases of "In-print" titles. Currency therefore is a key feature of the Nielsen BookData Search & Discovery Tools services which are continually updated by Nielsen BookData as it receives information and inputs it to the databases. Data is updated to Nielsen BookData Search & Discovery Tools on a daily basis.

22. Access to Service and Downloading

When the Licence is signed by the Site and returned to Chest access to Nielsen BookData's Search & Discovery Tools will be authorised by Chest to Nielsen BookData. Licensed Sites and their authorised End Users may print or download full or partial results of the searches of, and data in the databases subject to the terms and conditions of the Licence.

23. Access Management System

Access will be authenticated by IP addresses.

24. Pricing

For convenience, the pricing details for this Agreement are contained within this Pricing Table.

For pricing purposes, HE Institutions are divided into Large, Medium and Small. Further details of price banding are available in the Banding document.

All FE Colleges are classed as Small institutions.

For the Republic of Ireland "Universities" are classed as Large and "Third Level Colleges" are Small.

For Associated Sites the price is negotiable direct with Nielsen BookData.

For Scandinavia and the Netherlands, all sites are offered at the "Medium" rate regardless of actual size.

NHS, Research Council and Charity sites are offered at the "Small" rate regardless of actual size.

Note: All prices are shown exclusive of VAT.

Please note: "Site" refers to a single geographical location for all institutions except UK Universities and FE colleges, where a "Site" means the entire Institution.

"Users" refers to concurrent users of the database.

"Standalone" means one user at any one time on any computer at the said "Site".

25. Payment Terms

On receipt of a completed Licence, Sites will be invoiced for the Agreement year in which the Licence is signed. For each subsequent year, Sites will be invoiced three months in advance of the anniversary date of the Agreement on 1 June 2007 and 2008.

Prorata charging for Sites which become licensed part-way through a year is available.

All payments must be made to "Eduserv" within 30 calendar days of the date of invoice.

Note: You are advised that because of the requirement for Chest to collect monies due before the anniversary date two charges may fall initially into one academic accounting year.
