Licence Information

1. Agreement Details

This Overview represents the detail of the formal Agreement which exists between Eduserv Chest and NewsBank. The following sections are written to enable Institutions to make a decision as to whether or not the product is appropriate for their needs.

1.1 Product Name

Access UK and Ireland Newspapers (HE & FE New & Renewing sites)

This package includes 50 of the major national and regional newspapers as well as over 190 newly added county community newspapers. Full-text back to 1998 up to current is included for most titles. This package also includes The Financial Times, 1996 to current. The Times, 1985 to current, a title previously only available as an add-on option, is also included. Full Title list here

NewsBank Newspapers UK National Package (HE & FE renewing sites only)

This full-text collection was created for libraries seeking a discrete collection of national newspapers. All news articles are included for each title. All articles are covered in their entirety. For background coverage, the date for all titles will be 1998 to current. Included in the package is The Daily Mail, The Independent, The Guardian, The Sunday Telegraph, The Times, and News of the World.

NewsBank Newspapers Non-UK International Package (HE & FE New & Renewing sites)
The International Package includes full-text newspapers from over 30 countries, including the USA, Canada, Australia, China, India, Russia, Turkey, and Lebanon. Some titles have back files dating back to 1985. All titles have the current holdings. Newspapers include New York Times, Chicago Tribune, China Daily, Kuwait Times, and Moscow Times. 1.5 Agreement & Site Commitment Periods

This is a rolling Agreement which commenced on 1st January 2008.  Institutions may participate at any time during the period; however they will be bound until the end of their three year licence period which ends 31st December unless the agreement is terminated by NewsBank upon giving 30 days notice.

2. Eligible Institutions

This Agreement is available to Higher and Further Education in the UK and third level colleges in the Republic of Ireland.

4. Product Description

NewsBank provides colleges and universities with unlimited Web-based access to the largest newspaper database in existence.

A comprehensive resource for up-to-date news and information
Filled with valuable records, facts, statistics, analysis, references, quotations, lists and much more, newspapers from across town and around the world reflect different experiences, perspectives and bodies of knowledge. Newspapers provide essential background information and details on who, what, when, where and why. Also, local newspapers from communities directly affected by a particular issue, trend or event often provide the most authoritative coverage, long before and after national or international publications, which may offer valuable “big-picture” analysis.

Significance of local coverage
Newspaper collections commonly satisfy users' need for grassroots coverage, including articles on topics of local interest, coverage of area politics and legislation, events calendars and other information not available from any other source. This includes, for instance, a write-up of a high school football game, legal notices, public announcements, popular recipes, letters to the editor and records of births, marriages and deaths. Of all local media and news sources, newspapers offer the most extensive, up-to-date record of emerging and ongoing local issues, personalities and stories of interest.

Valuable local, regional, national and international perspectives
Issues and events are perceived differently across town, around the country and throughout the world. By accessing newspaper articles from different geographic areas, users are likely to find information reflecting different opinions and experiences. By comparing these varying viewpoints from different regions, researchers are better prepared to form their own educated conclusions.

Track subjects historically and geographically
By providing access to both current newspaper issues and years of archives, Web-based newspaper databases enable users to track and thoroughly analyze information on countless subjects over time—from the earliest stages to their current status. Also, by searching titles from hundreds of small towns and big cities worldwide, users can track subjects or trends regionally and as they move across borders. Few other resources offer this unique capability.

 

5. Licence Type

Site licence with normal Chest terms and conditions of use. Downloading of the Data is allowed at any Institution for use by any member of staff or student in accordance with the standard "Code of Conduct" for the Use of Software or Data

6. Personal Licences

Not applicable.

7. Post Termination of Agreement Period

Material downloaded under the agreement before its expiry may continue to be used under the same licence conditions as pertain while the agreement exists. Once the agreement has terminated then no further access to the service will be possible unless the Agreement is renewed or extended. If the Agreement is renewed or extended then the new conditions will apply. If the Agreement is not renewed then renewal is a matter between Institutions and NewsBank.

8. Alterations/Additions to Databases and New Functionality

Any additional features or functionality that become included as a standard part of the products covered by this agreement will be included within this agreement at no extra cost.

9. Location and Use Permissions

"Authorised Users" are those individuals, who must be currently registered students, faculty members or employees of the licensed institution, who are authorised by the licensee to access the licensee's information services whether from a computer or terminal on the licensee's secure network or off site via a secure access management system. A walk-in user is a person who is not a currently registered student, faculty member or employee of the licensed institution, but is permitted to access the secure network only via a computer or terminal within the licensee's premises, and is deemed to be an authorised user.

NOTE: the granting of an Athens Username and Password is not a right to use in itself.

For clarity, and in response to frequently asked questions, the following additional definitions are given.

Alumni:

Graduates of an Institution.

Use should terminate upon graduation and not be permitted again unless the graduate again qualifies under the terms for employees and students.

Distance Learning:

Distance learning is any learning that takes place with the instructor and/or necessary materials geographically remote from the student. For example distance learning may occur by surface mail, video, interactive or cable TV, satellite broadcast, or any number of Internet technologies such as message boards, chat rooms, and desktop video or computer conferencing. The student may be either normally UK domiciled or permanently domiciled overseas.

Students studying via Distance Learning can be categorised as:

  1. UK domiciled, UK Based, i.e. all Students resident and studying within the UK.
  2. Non-UK domiciled, UK based, i.e. a Student with an overseas home address but studying within the UK.
  3. UK domiciled, non-UK based, i.e. British nationals on business or studying abroad.
  4. Non-UK domiciled, non-UK based. i.e. Overseas home address studying abroad.

The licence for NewsBank Newspapers permits such use.

Honorary Members of Staff:

Persons of eminence in their field, and those who perform extraordinary meritorious service to an Institution.

Such use would be permitted except where the user was doing so in pursuit of their non-academic activity.

People from Industry on Courses run for their Employer:

Industrial placement.

Such use is specifically excluded from licence for NewsBank Newspapers.

Remote Access within the UK and the Republic of Ireland:

Access to data service and content geographically remote from the licensed institution but within the boundaries of the UK and Ireland.

The licence for NewsBank Newspapers permits such use.

Remote Access Overseas:

Access to data service and content via a licensed institution from outside the UK and Ireland.

The licence for NewsBank Newspapers permits such use.

Retired Members of Staff:

Former employees of a licensed institution.

Use rights terminate upon cessation of employment, except in the instance where the employee becomes a student.

Student Placement in Industry:

A registered student of an institution who combines academic study with periods of practical work experience. E.g. Sandwich Students.

Any use for the benefit of the students employer is specifically excluded.

10. Background Detail/Community Evaluation

The Agreement is a continuation from the original three year agreement which began on 1st January 2002 and was first renewed in 2005.

11. Institution Evaluation

Free 30 day trials are available to interested sites by completing the licence form and returning to Eduserv Chest. At the end of the trial period Chest must be notified by email and the licences will be processed or destroyed

12. Product Documentation

Not applicable. The product comprises the newspapers.

13. Right to Copy Documentation

Articles may be printed, downloaded or emailed

14. Training and Training Materials

Training is not required.

15. Document Delivery

Articles may be printed, downloaded or emailed.

Minimum Browser Requirements for NewsBank InfoWeb

NewsBank will be functional for all users whose browsers and systems meet the MINIMUM requirements detailed in the table below.

Enhancements provided by meeting the RECOMMENDED requirements include increased viewing area (less scrolling required) and more easily accessible controls such as buttons, drop-down fields, and dialog boxes.

21. Access to Service and Downloading

When the Licence is signed by the Site and returned to Chest access to NewsBank Newspapers will be authorised by Chest to the Service Provider.

Licensed Sites and their authorised End Users may print, download or email articles from the newspapers to which they have access subject to the terms and conditions in the Licence.

Details of how access will be set up for licensed institutions and how they will be contacted with details on how to access the service.

Signing Up

24. Pricing

Licensee will pay to Eduserv an initial fee plus VAT and subsequent annual charges plus VAT as per the prices on the licence form.  The initial fee will be due on receipt of licence.  Thereafter an annual payment plus VAT will be due three months in advance of the anniversary date of the Agreement.  There is prorata charging for Sites which become licensed partway through a licence year. 

25. Payment Terms

On receipt of a completed Licence, Sites will be invoiced for the Agreement year in which the Licence is signed.

For each subsequent year, Sites will be invoiced three months in advance of the anniversary date of the Agreement (invoice date: 1st October 2008 and 2009).

Quarterly pro-rata charging is available.

All payments must be made to the "Eduserv" within 30 calendar days of the date of invoice.

Note: You are advised that because of the requirement for Chest to collect monies due before the anniversary date two charges may fall initially into one academic accounting year.
