1. Agreement Details

This Overview represents the detail of the formal Agreement which exists between Eduserv and EBSCO. The following sections are written to enable Institutions to make a decision as to whether or not the product is appropriate for their needs.

(v) Agreement Period

The Agreement which commenced on 1st October 1999 was extended to 30th September 2005 and has now been extended for a further 3 years, to 30th September 2008. There are options for Sites to subscribe for one, two or three years.

Institutions may participate at any time during the period and will be bound until the end of the licence period chosen. Institutions will receive a pro-rata invoice in the year they first subscribe. This will cover the number of months remaining in the Agreement year in which they first subscribe.

2. Eligible Institutions

This Agreement is available to Higher and Further Education in the UK, Research Councils and Third Level Colleges in Ireland [Chest(Ireland)] and Associated Sites.

These databases are designed specifically for use in the Higher Education community, with 'UK & Eire Reference Centre' being more specific to FE Colleges, and offer the following benefits:

The following descriptions have been provided by EBSCO.

Academic Search Elite provides full text for more than 2,050 publications, including more than 1,500 peer-reviewed journals. In addition to the full text, indexing and abstracts are provided for all 3,476 journals in the collection. This database offers information in nearly every area of academic study including: computer sciences, engineering, physics, chemistry, language and linguistics, arts & literature, medical sciences, ethnic studies and more. Examples of titles offered in Academic Search Elite include: British Journal of Psychology, British Journal of Sociology, Central European History, Contemporary Literature, Journal of Social Psychology, Library Journal, Social Forces, Sociological Review, Theological Studies, Women's Studies, etc. In addition to journal coverage, Academic Search Elite provides full text information from a variety of source-types such as scholarly monographs. The majority of full text titles are available in native (searchable) PDF, or scanned-in-colour. Full text information in this database dates as far back as 1985.

Business Source Elite provides full text coverage for 1,133 scholarly business, management and economics journals, including more than 500 peer-reviewed publications. In addition to the full text, this database offers indexing and abstracts for more than 1,800 journals. Business Source Elite contains full text from the world's top management and marketing journals including Business Week, Forbes, Harvard Business Review, MIT Sloan Management Review, California Management Review, Administrative Science Quarterly, Academy of Management Journal, Academy of Management Review, Industrial & Labor Relations Review, Journal of Management Studies, Journal of Marketing Management, Journal of Marketing Research (JMR), Journal of Marketing, Journal of International Marketing, etc. This database includes full text (PDF) coverage dating back as far as 1985, and detailed company profiles for the world's 10,000 largest companies. This database is updated daily on EBSCOhost.

Business Source Premier , designed specifically for business schools and libraries, provides full text for nearly 7,600 scholarly business journals and other sources, including full text for more than 1,125 peer-reviewed business publications. This database offers information in nearly every area of business including management, economics, finance, accounting, international business, and more. Business Source Premier contains full text from the world's top management and marketing journals including Harvard Business Review, California Management Review, Administrative Science Quarterly, Academy of Management Journal, Academy of Management Review, Industrial & Labor Relations Review, Journal of Management Studies, Journal of Marketing Management, Journal of Marketing Research (JMR), Journal of Marketing, Journal of International Marketing, etc. The database also includes other sources of full text information such as country economic reports from the EIU, Global Insight, ICON Group and CountryWatch and detailed company profiles for the world's 10,000 largest companies. Business Source Premier provides expanded indexing and abstract backfiles for the top scholarly business journals, dating back to 1965 or the first issue published (whichever is more recent). In some cases, indexing, abstracting, and PDF coverage actually goes back further than 1965; for example, Academy of Management Journal is available back to 1958, Accounting Review to 1926, Administrative Science Quarterly to 1956, California Management Review to 1958, Industrial & Labor Relations Review to 1947, Journal of Accounting Research to 1963, Journal of Finance to 1946, Journal of Marketing to 1936, Journal of Marketing Research (JMR) to 1964, Management Science to 1954, Operations Research to 1956, etc. More than 200 of the journals have PDF full text back to 1965 or the first issue published. Academic Search Premier , designed specifically for academic institutions, is the world's largest scholarly, multi-disciplinary full text database containing full text for nearly 4,700 publications, including more than 3,600 peer-reviewed publications. In addition to the full text, this database offers indexing and abstracts for all 8,172 journals in the collection. This scholarly collection offers information in nearly every area of academic study including: computer sciences, engineering, physics, chemistry, language and linguistics, arts & literature, medical sciences, ethnic studies, and many more. Academic Search Premier is an enormous collection of the most valuable peer-reviewed full text journals, offering critical information from many sources unique to this database. Biomedical Reference Collection: Basic
Biomedical Reference Collection: Basic provides doctors, research scientists, students, clinical specialists and managers with access to 100 full text journals covering such disciplines as clinical medicine, nursing, dentistry, veterinary medicine, the health care system and the preclinical sciences. All 100 full text journals contained in the database are also indexed in MEDLINE. Biomedical Reference Collection: Basic can be searched independently, but also allows users to conveniently link to full text from citations within MEDLINE. When this citation database is viewed via EBSCOhost there is the ability to link to full text for articles contained within the Biomedical Reference Collection: Basic database

UK & Eire Reference Centre has combined UK magazines and Irish magazines, newspapers, newswires, and reference books to create the largest collection of UK/Irish specific full text content available to libraries, in the United Kingdom. The Encyclopedia of Britain and the Encyclopedia of Ireland are included. This Reference Centre also includes many international magazines, newspapers & newswires, reference books and company information, as well as biographies and an image collection. Magazine coverage includes full text of publications such as The Economist, History Today and many more. Newspaper coverage includes full text of publications such as The Times, The Mail and many, many regional newspapers.

Health Source: Nursing/Academic Edition provides more than 550 scholarly full text journals, including nearly 450 peer-reviewed journals focusing on many medical disciplines. Also featured are abstracts and indexing for more than 800 journals. Coverage of nursing and allied health is particularly strong, including full text from Creative Nursing, Issues in Comprehensive Paediatric Nursing, Issues in Mental Health Nursing, Journal of Advanced Nursing, Journal of Child & Adolescent Psychiatric Nursing, Journal of Clinical Nursing, Journal of Community Health Nursing, Journal of Nursing Management, Journal of the Society of Paediatric Nurses, Nursing Diagnosis, Nursing Ethics, Nursing Forum, Nursing Inquiry, and many more. In addition, this database includes Clinical Pharmacology, which provides access to up-to-date, concise and clinically relevant drug monographs for all U.S. prescription drugs, hard-to-find herbal and nutritional supplements, over-the-counter products and new drugs. Hospitality and Tourism IndexTM is a bibliographic database covering scholarly research and industry news relating to all areas of hospitality and tourism. This comprehensive index combines the records of three renowned collections: Cornell University's former Hospitality database, Articles in Hospitality and Tourism (AHT), formerly co-produced by the Universities of Surrey and Oxford Brookes, and the Lodging, Restaurant & Tourism Index (LRTI), formerly produced by Purdue University. Together, this collection contains more than 480,000 records from 500 titles, with coverage going back to the mid 1960s. Sources are both domestic and international in range and scope, with material collected from countries and regions such as Canada, Australia, Europe and Asia. Publications include Hotel & Motel Management, Journal of Leisure Research, Nation's Restaurant News, Restaurants & Institutions and many more. Subject areas covered include demographics & statistics, development & investment, food & beverage management, hospitality law, hotel management & administrative practices, leisure & business travel, market trends, technology and more. EBSCO plans to increase the coverage of relevant, well-respected periodical literature and non-traditional content.

LinkSource LinkSource is a powerful link resolver, designed to extend research collections to take advantage of all available resources. The LinkSource menu is easily configured to support links to full text and secondary databases, search engines, document delivery services, interlibrary loan vendors, online catalogues, etc.

5. Licence Type

Site licence with normal Chest and EBSCO terms and conditions of use. Information is copyright cleared for personal use. Downloading of the Data is allowed at any Institution for use by any member of staff or student in accordance with the standard "Code of Conduct" for the Use of Software or Data.

6. Personal Licences

Not applicable

7. Post Termination of Agreement Period

At the end of the agreement it will either be:

  1. renewed, and all conditions in the renewed agreement will apply;
  2. not renewed, in which case each institution will have the opportunity to purchase DVD ROM and CD ROM back up files direct from EBSCO;
  3. re-negotiated.

8. Alterations/Additions to Databases and New Functionality

It is the policy of EBSCO to expand the coverage of its databases. New product developments, up-to-date title lists and access to the EBSCO list server etc. can be found on the EBSCO home page http://www.epnet.com

9. Location and Use Permissions

The following clarification with regard to the right to be an End-User is given following a review of frequently asked questions (faq). Products, unless there is a clear statement to the contrary are only licensed for use by staff, students and other persons 'engaged in the normal business of the licensed institution'. All right to become an authorised End-User is determined by this wording. For full detail see Clause 3 "Use" in Appendix A to the Licence.

DISTANCE LEARNING:

Distance learning is any learning that takes place with the instructor and/or necessary materials geographically remote from the student. For example distance learning may occur by surface mail, video, interactive or cable TV, satellite broadcast, or any number of Internet technologies such as message boards, chat rooms, and desktop video or computer conferencing. The student may be either normally UK domiciled or permanently domiciled overseas.

Students studying via Distance Learning can be categorised as:

  1. UK domiciled, UK Based, i.e. all Students resident and studying within the UK.
  2. Non-UK domiciled, UK based, i.e. a Student with an overseas home address but studying within the UK.
  3. UK domiciled, non-UK based, i.e. British nationals on business or studying abroad.
  4. Non UK-domiciled, non-UK based. i.e. Overseas home address studying abroad.

The licence for EBSCO Databases permits such use.

REMOTE ACCESS within UK and EIRE:

Access to data service and content geographically remote from the licensed institution but within the boundaries of the UK and Eire.

The licence for EBSCO Databases permits such use.

REMOTE ACCESS Overseas:

Access to data service and content via a licensed institution from outside the UK and Eire.

The licence for EBSCO Databases permits such use.

STUDENT PLACEMENT IN INDUSTRY:

A registered student of an institution who combines academic study with periods of practical work experience. E.g. Sandwich Students.

Any use for the benefit of the students employer is specifically excluded.

PEOPLE FROM INDUSTRY ON COURSES RUN FOR THEIR EMPLOYER:

Industrial placement.

Such use is specifically excluded from licence for EBSCO Databases.

RETIRED MEMBERS OF STAFF:

Former employees of a licensed institution.

Use rights terminate upon cessation of employment, except in the instance where the employee becomes a student.

HONORARY MEMBERS OF STAFF:

Persons of eminence in their field, and those who perform extraordinary meritorious service to an Institution.

Such use would be permitted except where the user was doing so in pursuit of their non-academic activity.

ALUMNI:

Graduates of an Institution.

Use should terminate upon graduation and not be permitted again unless the graduate again qualifies under the terms for employees and students.

WALK-IN USERS:

Public access and Library terminals.

The licence for EBSCO Databases permits use by walk-in visitors or general public users provided that security procedures are undertaken that will prevent remote access by institutions or individuals that are not parties to the licence who are not expressly and specifically granted access by EBSCO.

It remains a requirement of the Licensee (Institution) that it is satisfied that the user is an employee, student, or other persons authorised by the Licensee for the purposes of the normal business of the Licensee's organisation.

NOTE: the granting of an ATHENS Username and Password is not a right to use in itself.

SUPPORT

10. Background Detail / Community Evaluation

This is an extension to the Agreement with EBSCO which has been in existence since 1999.

11. Institution Evaluation

Access to a free 60 day evaluation period is available on request via Chest or direct from EBSCO.

12. Product Documentation

EBSCO will provide 1 copy per licensed site of any relevant documentation or reference material that it produces and makes commercially available. EBSCO will also provide access to online information that may be downloaded from the EBSCO home page http://www.epnet.com for the individual institution members' own use.

13. Right to Copy Documentation

Copying of Licensed Materials is permitted for the individual's own use.

14. Training and Training Materials

The Agreement includes the provision of training and training materials directly from EBSCO.

15. Document Delivery

A document delivery function is at present not available but is currently in development. A "pay by the article" electronic document delivery available via links to EBSCO Online.

20. Updates

Updates to EBSCOhost databases are made on a daily basis.

21. Access to Service and Downloading

When the Licence is signed by the Institution and returned to Chest, access to the required database/s will be given and EBSCO will be notified. Licensed Sites and their authorised End Users may print or download full or partial results of the searches of, and data in the licensed database/s subject to the terms and conditions in the Licence.

22. Athens Access Management System

Access will be authenticated by use of Athens Management System.

23. Athens Registration Procedures

Each licensed institution is required to have an Athens Domain Administrator before registering for access to the data. Details can be located at http://www.athensams.net/sitereg.aspx

24. Pricing

There are various options for subscribing to the databases. Please see tables below. Pro-rata charging on a monthly basis is available for the first year of subscription. Considerable savings are to be made if your Institution is able to commit for 3 years from 1st October 2005, and even more if your Institution can pay for the 3 years in advance.

25. Payment Terms

On receipt of a completed Licence, Sites will be invoiced for the Agreement year in which the Licence is signed. For each subsequent year, Sites will be invoiced three months in advance of the anniversary date of the Agreement (invoice date: 1st July 2005, 2006 and 2007). Pro-rata charging is available for Sites which become licensed part-way through a year.

All payments must be made to Eduserv within 30 calendar days of the date of invoice.

Note 1: You are advised that because of the requirement for Eduserv to collect monies due before the anniversary date two charges may fall initially into one academic accounting year.

Note 2: Access to licensed Database(s) will be given to the Licensed Site on receipt of paperwork. However, non-payment by the due date may lead to access being removed on 24 hours notice.

26. How to Order

Two original copies of the relevant Licence (Schedule 4) are required and should be returned to:
