Licence Information

1. Agreement Details

This Overview represents the detail of the formal Agreement which exists between Eduserv and Content Online Limited. The following sections are written to enable Institutions to make a decision as to whether or not the product is appropriate for their needs.

1.5 Agreement & Site Commitment Periods

This Agreement commences 1st June 2008 and terminates 31st May 2009. Institutions may participate at any time during the period.

The Institution commits to pay a three year upfront fee on signing up to this agreement which will licence that institution for use of the product for three years
Or
An institution can commit to a one year term.
Rights vary in accordance with the commitment period.

2. Eligible Institutions

This Agreement is available to Higher and Further Education institutions in the UK, the Rpublic of Ireland and select Chest Associated Sites.

3. Products Covered

Complete ASTMlibrary of books, journals, and papers

Access to the digital edition of nearly every ASTM International book and paper spanning 140+ industries and 100+ years including 1000+ books, 30,000+ papers, and 430,000+ pages of information.
Access to Peer reviewed and edited high-quality, market-relevant papers including:
Journal of ASTM International (JAI)
Journal of Testing and Evaluation (JTE)
Geotechnical Testing Journal (GTJ)
Journal of Forensic Sciences 1972-2005 (JOFS)
Journal of Composites, Technology and Research (JCTR)
Journal of Cement, Concrete and Aggregates (CCA) 

Gain insight into the technology and developments leading to new standards. Special Technical Publications (STPs) are collections of peer-reviewed papers, ususally presented at symposia sponsored by ASTM's 140 technical committees.

5. Licence Type

Site licence

 

On initially accessing the ASTM Digital Library & Standards Package (the Package) through the ASTM International website, a user at a Licensed Institution will be guided through a standard ASTM International “click-through” licence.  The user will have to accept the Terms and Conditions of this licence to gain access to the Package.  The Terms and Conditions which apply to a Licensed Institution purchasing access to the Package through the Eduserv Chest/Content Online Agreement are the Terms and Conditions of the Eduserv Chest/Content Online Agreement and the Terms and Conditions of the ASTM International “click-through” licence.  Licensed Institutions should satisfy themselves that they are content to abide by both sets of Terms and Conditions.  In the event of a conflict between the Terms and Conditions of the Eduserv Chest/Content Online Agreement and the Terms and Conditions of the ASTM International “click-through” licence then the Terms and Conditions of the Eduserv Chest/Content Online Agreement shall take precedence.

6. Personal Licences

Personal Licences are not available under this Agreement.

7. Post Termination of Agreement Period

1 year only licence – a licenced site retains right to everything published during that twelve month period.

3 year licence (paid upfront) – a licenced site retains right to access archive and everything published during that thirty six month period.

Material, for which these rights are held, may continue to be accessed and downloaded under the Agreement after its expiry and can continue to be used under the same licence conditions as pertain while the Agreement exists

8. Alterations/Additions to Databases and New Functionality

Additions to the content are included under this agreement.

 

The Digital Library is updated monthly.  The Standards package is updated weekly.

9. Location and Use Permissions 

Authorised Users:

Authorised User" means a type of User who is a currently registered student of the Licensee, a faculty member or an employee of the Licensee, in each case authorised by the Licensee to access the Licensee's library and information services whether from a computer or terminal on the Licensee's Secure Network or offsite via a Secure Access Management System or, in the case of Licensed Materials, access to the Licensee's onsite library facilities .

Other Permitted Users:
Means the following categories of User that are permitted to have access to the Products via a Licensee’s library and information services whether from a computer terminal on the Licensee’s Secure Network or offsite via a Secure Access Management System or via the Licensee’s onsite library facilities:

 

Excluded users:
"Alumni" means former staff and students of an Institution. This Agreement does not allow use by Alumni.



USAGE

Inter-Library Loan
The licence for ASTM permits Inter-Library Loan by supply from Licensed Institution to an authorised user of another library (whether by post, fax or secure electronic transmission, using Ariel or its equivalent, whereby the electronic file is deleted immediately after printing) a paper copy of an electronic original of parts of the Licensed Work


Incorporation of parts of the Licensed Work
The licence for ASTM permits incorporation of parts of the Licensed Work for use by Authorised Users in printed and electronic course packs, study packs, resource lists and in any other material to be used in the course of instruction and/or in virtual and managed environments hosted on a Secure Network.  Incorporation in printed or electronic form in assignments and portfolios, theses and in dissertations including reproductions of same for personal use and library deposit.  Each item shall carry appropriate acknowledgement of the source, listing title and copyright owner

Incorporation of parts of the Licensed Work
The licence for ASTM permits the right to deposit the learning and teaching objects as created above in electronic repositories operated by the Licensee on a Secure Network and in the JORUM Repository. The access and use of such learning and teaching objects shall be governed by the terms and conditions of the applicable repository.

10. Background Detail/Community Evaluation

This agreement has been negotiated following feedback from institutions after a trial was made widely available to UK institutions.

11. Institution Evaluation

E ach Institution is offered a one-time option of obtaining pre-subscription free trial access to the Products for a period of thirty days at any time during the Term subject only to the availability of the Products.  Such a trial shall include the right to twenty-five downloads;. Please apply to Edsuerv.

13. Right to Copy Documentation

Copying of electronic documentation is permitted.

14. Training and Training Materials

Training is included in the Fee if it is requested by a Licensed Institution.  It will be provided by the Content Online over the internet/web via the Webex service, as listed at http://www.webex.co.uk/

21. Access to Service and Downloading

Institutions have the option to submit licences to Eduserv in hard copy form by post or fax or in electronic format. Once the licence documentation has been received by Eduserv access to ASTM will be authorised by Eduserv to Content Online  Licensed Institutions and their authorised end-users may print or download full or partial results of the searches of, and data in the databases, subject to the terms and conditions in the Licence.

25. Payment Terms

Payment is due on receipt of licenceThere shall be no prorating of the feeEach licence shall be valid for a 1 or 3 year period from date of issue.

All Purchase Orders must be made out to Eduserv and Eduserv's invoices must be paid within 30 calendar days of the date of the invoice .
