This Agreement will remain in force from 1 August 2005 until 31 July 2010. Institutions have been able to select either a 3 year or 5 year licence.

Sites can extend a 3 year licence for a further 2 years from 1 August 2008 to 31 July 2010.
Sites joining in the last 2 years of this agreement will be committed from the time of signing to 31 July 2010
The Agreement to which this refers is a formal agreement between Eduserv and NAG.
This Agreement is available to institutions of Higher and Further Education in the United Kingdom. As with the previous NAG agreements, the Research Councils are excluded.
Chest has had agreements for NAG Software since 1990, during which time as many as 75 sites have taken advantage of one or all of the agreements. This new Agreement extends the licence period to 2010.
The Agreement covers the following products:

The charges also include support, new versions, system releases and associated new documentation. New platforms will be available within the charges if and when commercially available from NAG.

Authorised Users
It is a requirement of the Licensee (Institution) that it is satisfied that the user is an employee, student, or other person authorised by the Licensee for the purposes of the normal business of the Licensee's organisation.

Please refer to the NAG website for full machine requirements of NAG products. The software is controlled by licence keys. New keys are issued by the NAG Response Centre support@nag.co.uk.

Site-wide licence
Site licence with normal Chest terms and conditions of use. Copying of the Software is allowed at any licensed Institution for use in accordance with Clause 3 of the General Licence Conditions and the standard "Code of Conduct for the Use of Software or Data"
Department Licence
With normal Chest terms and conditions of use except that use of the licensed software is restricted to the students registered with the Institution to conduct research work guided by the Head of the Licensed Department; attend classes associated with that Head of Department; and to instructors and researchers employed by the Institution to work with that Head of Department.
Personal copies are not available under this Agreement.
At the end of an Institution's licence sites are required to remove all copies of software from their systems and sign a termination letter.
Termination of NAG Products
Sites deleting an implementation from a licence are required to delete the NAG software from the licensed processor and destroy it. NAG software includes any NAG routines that have been embedded in software and distributed within the site.
Documentation is provided electronically in pdf or html format. It is also available from the NAG website www.nag.co.uk/support_documentation.asp. Users wishing to obtain printed documentation may purchase direct from NAG. A Documentation Order Form is provided on the NAG website
Copying of documentation and software is permitted.
NAG Training
In-house training on NAG products is available, for current prices contact NAG.
One copy of system releases and/or new versions will be sent by NAG to Licensed Sites as and when they become commercially available.
Sites holding site-wide licences are entitled to up to a maximum of six Technical Contacts per product licensed.
Sites holding department licences are entitled to two Technical Contacts per product licensed.
Additional pairs of Technical Contacts may be added for a charge of £250 plus VAT per annum.
Telephone support will be provided by NAG to the designated Technical Contact(s) or his/her deputy(ies).
A form is provided to record the Technical Contact details for the first two products licensed. Changes to these details, and details of contacts for third and subsequent products should be recorded on a Modification to Schedule 4 Form.

Note that this list is for discussion and whilst NAG may subscribe to this list this is not a formal support route. Technical contacts at licensed sites are advised to join the list as they will be used by Chest to communicate information relating to the Agreement.

Notes:
5Year Licences
3 Year Licences extended for a further 2 years
On receipt of a completed Licence, or Modification to Schedule 4 and Implementation Form, Sites will be invoiced for the Agreement year in which the Licence is signed.
3&5 Year Licences
For each subsequent year, Sites signing up to the Agreement on or before 31 March 2005 will be invoiced on 1 February for each licence year, the final invoice to cover the period to 31 July 2008 or 2010 depending on licence period chosen. Sites signing up to the Agreement after 31 March 2005 will be invoiced three months in advance of the anniversary date of the Agreement (invoice date: 1 May) the final invoice to cover the period to 31 July 2008 or 2010 depending on licence period chosen.
3 Year Licence Extended for Further 2 Years
For each subsequent year, Sites signing up to the Agreement on or before 31 March 2008 will be invoiced on 1 February for each licence year, the final invoice to cover the period to 31 July 2010. Sites signing up to the Agreement after 31 March 2008 will be invoiced three months in advance of the anniversary date of the Agreement (invoice date: 1 May) the final invoice to cover the period to 31 July 2010.
The annual fee will be pro-rated by six months for sites that become licensed (or if products are added to a site's licence) in the second half of an Agreement year.
Sites may, if they wish, pay a single charge (as detailed in the "Pricing Table") to cover a 3 year licence or a 5 year licence or as detailed in the "Prices to Extend 3 Year Licence Table" to cover a 2 year extension to a 3 year licence for the period to 31 July 2010.
All payments must be made to "Eduserv" within 30 calendar days of the date of invoice.
Note: You are advised that because of the requirement for Chest to collect monies due before the anniversary date two charges may fall initially into one academic accounting year.
The master copies of media and Licensed Materials will be delivered to the Licensed Site by NAG when the Licence (Schedule 4) or Modification to Schedule 4 is signed by the Site and returned to Chest. See "How to order" below.

(i) To join the new Agreement
ALL SITES ARE REQUIRED TO COMPLETE THE FOLLOWING DOCUMENTS:
* Please note that if you wish to extend your 3 year licence for a further 2 years then you will need to complete a Modification Form.
These documents should be returned with an official purchase order to cover the full licence fees.
(ii) To add/remove product(s)/platforms to/from an existing licence
Where sites are adding products that DO NOT affect the charge banding that they are in, then a message to Chest will suffice.
Sites that are exchanging or deleting products/implementations, even if the charge banding is not affected, are required to complete the following form:
* Implementations Form - Please indicate which products/implementations are being added/deleted and sign the Termination Letter for the deleted products/implementations.
Sites that are adding, exchanging or deleting products/implementations which DO affect their licence fees, are required to complete the following forms:
* Modification to Schedule 4- 1 copy. (Also to be used to add/change Technical Contact details).
Sites licensing either of these products should complete the Modification to Schedule Form and the Implementation Order Form and return to Chest with an official purchase order.
