1. Agreement Details

1.4 Agreement Period

This is a 3 year Agreement commencing on 1st June 2008 and terminating on 31 May 2011. Only three year support licences are available.

1.5 Institution Commitment Period

Institutions may participate at any time during the period; however, they will be bound by the terms and conditions, including payments for three years from their enrolment.

The Agreement to which this refers is a formal Agreement between Eduserv and Waterloo Maple Inc.

2. Eligible Sites

This Agreement is available to Institutions of Higher and Further Education in the UK and Research Councils in the United Kingdom, and to Higher and Further Education Institutions (Third Level Colleges) in the Republic of Ireland .

Maple
Mathematics software tool providing a mathematical computation engine with integrated numerics and symbolics. Thousands of mathematical functions, hundreds of 2-D and 3-D plotting routines, and professional publishing tools.

5. Licence Type

This Site licence is subject to standard Chest terms and conditions with special terms and conditions of use (Schedule 4, Part 3 - Special Licence Conditions). Copying of the Software is allowed at any Institution for use by any member of staff or student in accordance with the standard Code of Conduct for the Use of Software and special conditions (Schedule 4, Part 3).

6. Personal Licences

Maple can be accessed from personal computers by students using a thin client network (e.g. Citrix, etc) or using remote access software (e.g. PCAnywhere, etc) only if the Student Distirbution Extensionhas been purchased. If the Student Distribution Extension has not been purchased then students may purchase a Personal Licence for £65 (excluding delivery and VAT) directly from Adept Scientific. 

Academic staff can apply for a free home use licence for Maple and the Maple Toolboxes by applying to Adept Scientific who will issue a single user Purchase Code.

7. Post Termination of Agreement Period

At the end of  the agreement period sites must remove the Maple and /or Maple T.A. software, along with any add-ons, from their systems.

8. System Releases, New Versions and New Functionality

One copy of system releases and/or new versions and new supporting documentation will be sent by the Supplier to each Licensed Institution as and when they become commercially available.

9. Location and Use Permissions

"Authorised Users" are those individuals, who must be a currently registered student, faculty member or employee of the licensed institution, who are authorised by the licensee (Institution) to access the Product.  

It is a requirement of the Licensee (Institution) that it is satisfied that the Authorised User is an employee, student, or other person authorised by the Licensee for the purposes of the normal business of the normal business of the Licensee's organisation.

10. Background Detail/Community Evaluation

MapleSoft were offering a site licence to institutions but with no banding (the same fee regardless of the size of the instutution). This site licence did not allow for remote access. The community expressed an interest for Eduserv to negotiate an Agreement which takes into account size of institutions an which provides provision for remote access.

This agreement does not include the provision of training and training materials other than the built-in examples. Group training is available from Adept Scientific at normal rates.

15. Initial Consultancy/Support

Chest fee is £250 per annum (no banding)

Pricing is fixed for three years at a time when sites join the agreement - however pricing is subject to annual review. Any increases to be notified to Eduserv by the last working day of the "tenth month" of the Agreement. Costs may rise by no more than the then current annual RCI as published by the Office for National Statistics.

21. Payment Terms

On receipt of a completed Licence, Sites will be invoiced for the Agreement year in which the Licence is signed. For each subsequent year, Sites will be invoiced one month in advance of the anniverasry date of the Agreement. Purchase orders and payments for the licence fee must be made out to "Adept Scientific plc". Invoices are payable within 30 calendar days of the date of invoice.

Price is fixed at time of sign-up to the Agreement for the full term of the 3-year licence.

Sites may, if they wish, pay a single charge to cover their commitment period (3 years). 

22. How to Order

Complete the attached Licence (Schedule 4), One Purchase order form made out to Adept Scientific for the licences and one Purchase order form made out to Eduserv for the Chest Fee and return them to:
