LICENCE INFORMATION

1. Agreement Details

This Overview represents the detail of the formal Agreement which exists between Eduserv and Springer. The following sections are written to enable Institutions to make a decision as to whether or not the product is appropriate for their needs.

(v) Agreement Period

This is an Agreement commencing 1 August 2007 and terminating on 31 July 2010. Sites can participate at any time during the period; however they will be bound until the end of the Agreement Period. Pro-rating will apply to the annual fees for Sites joining part way through an Agreement year.

2. Eligible Institutions

This Agreement is available to:

UK Higher and Further Education Sites, Chest sites in the Republic of Ireland and Norwegian Sites

4. Product Description

Lecture Notes in Computer Science (LNCS)
LNCS is a book series from Springer that reports the latest results from all areas of computer science and information technology research, development and education. The series is regarded as the platform for one of the world's most authoritative computer science research forums.  Access to the series goes back to 1997 under this agreement.

Lecture Notes in Mathematics
LNM reports in new developments in all areas of mathematics and their applications - quickly, informally and at a high level.

Lecture Notes in Physics (LNP)

LNP, founded in 1969, reports new developments in physics research and teaching - with a high quality and the explicit aim to summarise and communicate current knowledge in an accessible way. 
Landolt-Börnstein

Landolt-Börnstein is a descriptive collection of critically assessed data in all fields of physical chemistry. Content is listed in 3 main groups, from all fields of physics, physical chemistry, geophysics, astronomy and biophysics.  Special indexes allow for fast orientation either from the substance or property side.  The data collection presently provides access to more than 350 volumes within the New Series with approx 20 new volumes to be published each year. 
Landolt-Börnstein is an ideal series for researchers in the field of physics, physical chemistry, geophysics, astronomy, biophysics, as well as material science and engineering.
Access to the series goes back to 1997 under this agreement.

Eduserv Chest is pleased to advise that Mr Chris Gibson, Subject Specialist: Earth Sciences; Geography; Materials Science; Physics and Astronomy of John Rylands University Library of Manchester, who is the UK expert on the Landolt-Börnstein database, has agreed to act as a reference should you wish to discuss the value of the product. 5. Licence Type

Site licence with normal Chest terms and conditions of use. Downloading of the Data is allowed at any Institution for use by any member of staff or student in accordance with the standard "Code of Conduct" for the Use of Software or Data.

6. Personal Licences

Not available.

7. Post Termination of Agreement Period

Material downloaded under the agreement before its expiry may continue to be used under the same licence conditions as pertain while the agreement exists. Once the agreement has terminated then no further access to the service will be possible unless the Agreement is renewed or extended. If the Agreement is renewed or extended then the new conditions will apply. If the Agreement is not renewed then renewal is a matter between Institutions and Springer.

8. Alterations/Additions to Databases and New Functionality

Any additional features or functionality that become included as a standard part of the products covered by this agreement will be included within this agreement at no extra cost.

9. Location and Use Permissions

"Authorised Users" are those individuals, who must be currently registered students, faculty members or employees of the licensed institution, who are authorised by the licensee to access the licensee’s information services whether from a computer or terminal on the licensee’s secure network or off site via a secure access management system. A walk-in user is a person who is not a currently registered student, faculty member or employee of the licensed institution, but is permitted to access the secure network only via a computer or terminal within the licensee’s premises, and is deemed to be an authorised user.

NOTE: the granting of an ATHENS Username and Password is not a right to use in itself.

For clarity, and in response to frequently asked questions, the following additional definitions are given.

DISTANCE LEARNING:

Distance learning is any learning that takes place with the instructor and/or necessary materials geographically remote from the student. For example distance learning may occur by surface mail, video, interactive or cable TV, satellite broadcast, or any number of Internet technologies such as message boards, chat rooms, and desktop video or computer conferencing. The student may be either normally UK domiciled or permanently domiciled overseas.

Students studying via Distance Learning can be categorised as:

  1. UK domiciled, UK Based, i.e. all Students resident and studying within the UK.

  2. Non-UK domiciled, UK based, i.e. a Student with an overseas home address but studying within the UK.

  3. UK domiciled, non-UK based, i.e. British nationals on business or studying abroad.

  4. Non UK-domiciled, non-UK based. i.e. Overseas home address studying abroad.
The licences for Lecture Notes in Computer Science and Landolt-Börnstein permit such use.

REMOTE ACCESS within UK and EIRE:

Access to data service and content geographically remote from the licensed institution but within the boundaries of the UK and Eire.

The licences for Lecture Notes in Computer Science and Landolt-Börnstein permit such use.

REMOTE ACCESS Overseas:

Access to data service and content via a licensed institution from outside the UK and Eire.

The licences for Lecture Notes in Computer Science and Landolt-Börnstein permit such use.

STUDENT PLACEMENT IN INDUSTRY:

A registered student of an institution who combines academic study with periods of practical work experience. E.g. Sandwich Students.

Any use for the benefit of the students employer is specifically excluded.

PEOPLE FROM INDUSTRY ON COURSES RUN FOR THEIR EMPLOYER:

Industrial placement.

Such use is specifically excluded from licences for Lecture Notes in Computer Science and Landolt-Börnstein.

RETIRED MEMBERS OF STAFF:

Former employees of a licensed institution.

Use rights terminate upon cessation of employment, except in the instance where the employee becomes an authorised user.

HONORARY MEMBERS OF STAFF:

Persons of eminence in their field, and those who perform extraordinary meritorious service to an Institution.

Such use would be permitted except where the user was doing so in pursuit of their non-academic activity.

ALUMNI:

Graduates of an Institution.

Use should terminate upon graduation and not be permitted again unless the graduate again qualifies under the terms for employees and students.

WALK-IN USERS:

Public access and Library terminals.

Use by walk-in visitors or general public users is not allowed unless they are authorised users (see above) of th library resources. It is generally acknowledged that licensed institutions may be unable to segregate public or library computers from the rest of the network and that occasional walk-in, public use may occur.

It remains a requirement of the Licensee (Institution) that it is satisfied that the user is an employee, student, or other persons authorised by the Licensee for the purposes of the normal business of the Licensee's organisation.

10. Background Detail / Community Evaluation

This Agreement has been negotiated following a request from a UK University to achieve more affordable pricing for the Community.

11. Institution Evaluation

60 day trials are available from the Springer site at Metapress. In order to activate trial access please send an email to Monique van de Kamp at SpringerLink

12. Product Documentation

Marketing material, in both electronic and printed form can be provided. All content is online.

13. Right to Copy Documentation

Copying of Licensed Materials is permitted.

14. Training and Training Materials

Springer offers Webinars, online training over the Internet.  Please contact Monique van de Kamp for details of dates availble or check at http://www.springerlink.com/ under librarians.

15. Document Delivery

All information is available online.

20. Updates

Approximately 500 new volumes are added to Lecture Notes in Computer Science per annum, while both Lecture Notes in Mathematics and Lecture Notes in Physics publish 30 volumes per annum each.
Approximately 20 new volumes are added to Landolt-Börnstein each year
Additionally archival material from earlier years "Online E-Book Archives" covering data published prior to 1997 may be purchased seperately.

21. Access to Service and Downloading

When the Licence is signed by the Site and returned to Eduserv Chest, Springer will be notified and access to the licensed product(s) will be given.

Licensed Sites and their authorised End Users may print or download full or partial results of the searches of, and data in the licensed product(s) subject to the terms and conditions in the Licence. (See Downloading Policy in Appendix C to Schedule 4).

22. Athens Access Management System

Athens user name and password allows access to these resources.

23. Registration Procedures

Once the licences have been received by Springer from Eduserv Chest the Licensed Site will be contacted with information about how to access the service.

1 Archival access to Lecture Notes in Computer Science can be purchased by customers (RENEWING SITES) of at the end of the agreement for volumes published during the term of the agreement (2007-2010) on completion of the Addendum A to Schedule 4 for a fee of GBP 2988.

2 Archival access to Lecture Notes in Computer Science can be purchased by customers of (NEW SITES) at the end of the agreement for volumes published since 1997 up to 2006 and includes the volumes published during the term of the agreement (2007-2010) on completion of the Addendum A to Schedule 4 for a fee of GBP 4988.

Archival access fees to Lecture Notes in Mathematics and Physics for the period 1997 -2010 can be purchased at the end of the agreement on completion of Addendum A to Schedule 4 for a fee of £250 plus VAT per product.

Should the agreement not be renewed or the Licensed Site does not require an extension of the licence, the Archival Access option(s) can be purchased at the end of the agreement period. This option allows for access to volumes published during the term this agreement on a perpetual basis. To ensure continued access to the data/book series, the Addendum form complete with an official purchase order to cover the additional fees must be submitted to Eduserv Chest two months in advance of the end date of the agreement (that is, by 31st May 2010)

25. Payment Terms

On receipt of a completed Licence, Sites will be invoiced for the Agreement year in which the Licence is signed.

For each subsequent year, Sites will be invoiced three months in advance of the anniversary date of the Agreement (invoice date: 1st May 2008 and 2009).

Pro-rata charging is not available. 

All payments must be made to the "EDUSERV" within 30 calendar days of the date of invoice.

Note: You are advised that because of the requirement for Chest to collect monies due before the anniversary date two charges may fall initially into one academic accounting year.

26. How to Order

Two original copies of the Institution Licence Schedule are required and should be returned (without the Licence Terms) to:
