This is a 5 year Agreement commencing on 20 March 2005 and terminating on 19 March 2010. Institutions may participate at any time during the period; however they will be bound until the end of the commitment period selected for their licence.

(v) Commitment Period

Sites may commit for the period to 19 March 2008, or 19 March 2010. The earlier Commitment Period is only available to sites that sign up in the first year of the Agreement.

The earlier Commitment Period can be extended for a further two years on completion of a Modification to Schedule 4.

Institutions may participate at any time during the Agreement Period; however they will be bound until the end of the Commitment Period selected. There is no pro-rata charge for sites that join part way through an agreement year.

Sites may delete individual data from their licence at any time during the period of the Agreement, provided that they remain licensed for at least one data. Any reduction in licence fees resulting from the deletion of product(s) will be applied to the next annual invoice. No refunds will be given.

At the end of the Commitment Period, if the licence is not renewed, Sites are required to erase all copies of Barts Digital Maps from all electronic media, disk files and computer memory.

2. Eligible Sites

This Agreement is available to all Institutions of Higher and Further Education in the United Kingdom and Ireland, some Chest Associated Sites, and SURFdiensten in The Netherlands.

3. Background Detail / Community Evaluation

Chest has had an agreement with Collins Bartholomew for the supply of Digital Maps since 1990. The Agreement which was due to end on 19/03/05 has since been extended for a further 5 years and now covers additional Collins Bartholomew products.

* The Central London Vector data is a subset of the Greater London Vector data. Where a site licences both the Central London data and the Greater London data, no charge will be made for the Central London data.

The Agreement includes support, new versions, and system releases. Data updates will need to be requested from Eduserv Chest. A fee of £25 +VAT will be charged for each update to cover the cost of reproduction and media.

Other products may be provided during the lifetime of the Agreement.

7. Requirements

Machine requirements are impossible to define as memory and processing power required will be governed by software used. The disk capacity required will depend on how many and which databases are used.

8. Institution Evaluation Copy / Exhibition Licence

Sample CDs can be provided by Collins Bartholomew on request (see 18. Initial Consultancy/Support). Sites will need to specify the formats and data required. The area of the sample within each data cannot be specified.

9. Licence Type

Site licence with normal Chest terms and conditions of use. Copying of the Data is allowed at any licensed Institution for use in accordance with Clause 3 of the Licence and the standard "Code of Conduct for the Use of Software or Data" (but see 11. Special Licence Conditions below).

10. Special Licence Conditions

(i) Copyright Acknowledgement

Users' attention is drawn to Section 6 of the Agreement which states: The Licensee agrees not to remove or in any way modify any proprietary marking including any trade mark or copyright notices on or in the Collins Bartholomew Databases or its carrier medium or on any Documentation. The Licensee shall put up the following notice at the "customer log-in, display screen" to Barts Digital Maps:

In respect of the GB 1:10,000 street level Raster data, Collins Bartholomew are Resellers of this data, which is owned by Overview Mapping. Sites licensed for this data shall put up the following notice at the "customer log-in, display screen" to the GB 1:10,000 street level Raster data:

(ii) Use of data

Use of data over the internet is restricted to a single location map from each data purchased, no larger than 2048 x 1048 pixels in dimension, together with a Copyright Acknowledgement. All data can be provided over a licensed site's intranet, under normal Chest terms and conditions of use.

The above limited Internet/intranet use of data is permitted only to sites with a Site Licence.

Sites wishing to install the full data on their web site will require a special Education/Commercial licence, which can be acquired from HarperCollins upon request. Increased licence charges will be applied by HarperCollins for this special licence.

11. Personal Licences

Personal licences are not available under this Agreement.

12. Post Termination of Agreement Period

At the end of the Commitment Period, if no further extension is agreed between Eduserv and Collins Bartholomew, sites are required to erase all Collins Bartholomew products from all tapes, disk files and computer memory.

13. Product Documentation

The data is provided with a comprehensive on-line "Help" and "Readme" file and complimentary information. No printed documentation is provided.

14. Right to Copy Documentation

Copying of the Help and Readme files are permitted. (See 11. Special Licence Conditions above.)

15. Training and Training Materials

No training or training materials are provided under this Agreement.

16. System Releases, New Versions and New Functionality

The Collins Bartholomew Data is revised annually. The availability of upgrades will be announced on the chest-bartholomews JISCmail list and sites will be invited to order their replacement CDs. Chest will apply a charge of £25 + VAT per CD.

17. Initial Consultancy/Support

Support will be provided by Collins Bartholomew via a single contact or his/her deputy at each Site. Collins Bartholomew support can be reached through either of the following contacts:

Each database is distributed on a separate CD. The initial media sets will be provided to Licensed Sites by Collins Bartholomew, at a cost of £25 per CD when the Licence is signed by the Site and returned to Chest. The cost of media provided by Collins Bartholomew is £25 per CD and will be added to the initial licence fees, and invoiced by Eduserv.

Any reduction in licence fees resulting from the deletion or downgrade of product(s) will be applied to the next annual invoice. No refunds will be given.

19. Payment Terms

On receipt of a completed Licence, Sites will be invoiced for the Agreement year in which the Licence is signed.

Orders for additional product(s) will be invoiced on receipt of a Modification to Schedule 4

For each subsequent year, Sites will be invoiced three months in advance of the anniversary date of the Agreement (invoice date: 20^th December), the final fee to cover the period to 19^th March 2008 or 2010, as applicable.

There is no pro-rata charging for Sites which become licensed, or licence additional databases, part-way through a year. Where the removal of a database results in a reduction in licence fees, this will be applied to the next annual invoice. No refunds will be given.

All payments must be made to "Eduserv" within 30 calendar days of the date of invoice.

Note: You are advised that because of the requirement for Eduserv to collect monies due before the anniversary date, two charges may fall initially into one academic accounting year.

20. Method of Delivery of Product

Each database is distributed on a separate CD. The initial media sets will be provided to Licensed Sites by Collins Bartholomew, at a cost of £25 per CD when the Licence is signed by the Site and returned to Chest.

The cost of media provided by Collins Bartholomew will be added to the initial licence fees, and invoiced by Eduserv.

The availability of upgrades will be announced on the chest-bartholomews JISCmail list and sites will be invited to order their replacement CDs. Upgrades will be provided by Chest on a cost recovery basis. The current cost for this service is £25 + VAT per CD. This fee may vary during the lifetime of the Agreement.

These should be signed and returned to Chest with an official Purchase Order (payable to "Eduserv") to cover the cost of the licence. Please ensure that the Order covers the cost of licence fees for the full period of the Agreement.
